Terms of Service

These terms are an agreement between you and FormBull, LLC ("FormBull," "we," "us") for using formbull.com and the FormBull service. If you use FormBull for a business, you agree to these terms for that business and confirm you're authorized to do so. If you don't agree, don't use FormBull.

FormBull opens to the public on December 1, 2026. Before then, formbull.com offers information, an early-access list and demo calls, and a small group of businesses uses the service in a private beta. We'll update these terms before we launch. Customers get notice of material changes as described below.

1. The service

FormBull receives leads from your website forms, ad platforms, marketplace emails and other sources you connect, rings the people on your team, and, when someone presses 1, calls the lead and connects the two calls. It can also send alerts, record calls where you turn recording on, and produce call summaries. We may change or improve features over time.

2. Accounts

• You must be at least 18 and give us accurate business information, including the verification details carriers require (legal name, EIN, address, website and an authorized representative).
• You're responsible for your account, your users, and keeping your login secure. Tell us right away about unauthorized use.
• Each person who receives FormBull calls or texts must verify their own phone number and agree to receive them.

3. Your responsibilities for calls and consent

FormBull calls leads on your behalf and in your business's name. You are responsible for your leads and your calls, and you agree to:

• Send FormBull only leads who asked to be contacted by your business, with consent that meets the laws that apply to you, including the Telephone Consumer Protection Act and state calling and telemarketing laws.
• Use the consent language and settings we provide (or language your own counsel approves), and keep your forms and privacy policy accurate.
• Not upload or dial purchased, rented or scraped lists. FormBull is for inbound leads only.
• Honor opt-outs and do-not-call requests. We apply our own calling hours, attempt limits and suppression lists, and you agree not to work around them.
• Give any notice or get any consent required to record calls, if you turn recording on.
• Use only caller IDs you're allowed to use.

FormBull gives you tools and guardrails, not legal advice. Your lawyer has the final word on how you collect and use leads.

4. Acceptable use

You may not use FormBull to:

• Break any law, or harass, threaten or mislead anyone.
• Place calls or texts with an artificial or prerecorded voice to leads, or send marketing texts without the consent the law requires.
• Spoof or misrepresent your identity or caller ID.
• Sell products or services that carriers or our providers prohibit, including cannabis, firearms, high-risk financial products, debt collection, and adult content.
• Interfere with, probe, overload or reverse-engineer FormBull, or get around its limits or security.

We may suspend calling for an account, a number or a lead source to stop suspected abuse or legal risk, and we'll tell you why when we can.

5. Plans, trials and payment

• Plans, included leads, and prices for extra leads are listed on our website when you sign up. Prices are in US dollars and don't include taxes.
• Trials last 14 days, include up to 25 leads, and don't need a card. After a trial, the service continues only if you choose a paid plan.
• Paid plans renew monthly (or yearly, if you choose) until you cancel. We charge your payment method through our payment processor at the start of each period and charge extra leads after the period ends.
• You can cancel at any time. Cancellation takes effect at the end of the current period. Except where the law requires otherwise, payments aren't refunded.
• We'll give you at least 30 days' notice before a price change applies to you.

6. Your data

You own the lead and call data you send to or create in FormBull. You give us permission to use it to run the service for you, to meet legal obligations, and in de-identified form to improve FormBull. Our Privacy Policy explains how we handle personal information. When your account ends, you can export your data for 30 days, and then we delete it except records we must keep, such as opt-outs.

7. Our property

FormBull, its software, name, logo and mascot belong to us. We give you a limited, non-exclusive, non-transferable right to use the service during your subscription. If you send us feedback, we may use it without obligation to you.

8. Third-party services

FormBull depends on phone carriers and providers such as Twilio, Cloudflare, Google and Stripe, and connects to services you choose, like ad platforms and lead marketplaces. We aren't responsible for those services, and carriers can delay, label or block calls and texts for reasons outside our control.

9. Disclaimers

FormBull is provided "as is" and "as available." To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't promise that every call will connect, that every lead will answer, or that the service will be uninterrupted or error-free.

10. Limitation of liability

To the extent the law allows, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or jobs. FormBull's total liability for any claim is limited to the amount you paid us in the 12 months before the claim arose, or $100 if you haven't paid us. These limits don't apply to your obligations under sections 3, 4 and 11.

11. Indemnity

You'll defend and indemnify FormBull against claims, fines and costs arising from your leads, your consent practices, your calls and recordings, or your breach of these terms or the law.

12. Ending the agreement

You can stop using FormBull and cancel at any time. We may suspend or end your access if you breach these terms, don't pay, or create legal or security risk. Sections that by their nature should survive (such as 3, 6, 9, 10, 11 and 13) survive.

13. Law and disputes

These terms are governed by the laws of North Carolina, without regard to conflict-of-laws rules. Any dispute will be brought in the state or federal courts in Wake County, North Carolina, and both parties consent to those courts.

14. Changes to these terms

We may update these terms. We'll change the date at the top and, for material changes, email customers at least 30 days before they take effect. Using FormBull after that means you accept the new terms.

15. General

These terms, with our Privacy Policy and SMS Terms, are the whole agreement between us about FormBull. If part of them can't be enforced, the rest still applies. You may not transfer these terms without our consent; we may transfer them in a merger or sale. Not enforcing a right isn't a waiver of it.
